We Act Quickly

Valid notices are processed promptly. Counter-notices are handled the same way.

1. Overview

KichuKichu respects the intellectual property rights of others and expects its users to do the same. If you believe that content available on KichuKichu infringes a copyright you own or control, you may submit a takedown notice to our designated copyright agent.

This page explains how to submit a notice under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and how to respond if content you posted has been removed.

2. Our Position on AI Content

KichuKichu is a platform for 100% AI-generated imagery. All images on the site are computer-generated from text prompts and do not depict real people, real places, or real photographs.

That said, generative AI models can occasionally produce output that resembles existing imagery. If you believe a generated image is substantially similar to a work you own, we take your concern seriously and will act on valid notices under the DMCA.

Good-faith notice: under the DMCA, you must have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.

3. Filing a Takedown Notice

To request removal of allegedly infringing content, please follow these steps:

Identify the copyrighted work Describe the work you believe is being infringed. If multiple works are involved, provide a representative list.

4. Required Information

For a takedown notice to be valid and actionable under the DMCA, it must contain all of the following elements:

Element What to include
1. Your signature A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. The work Identification of the copyrighted work claimed to have been infringed, or, if multiple works, a representative list.
3. The location Identification of the material you claim is infringing — the exact KichuKichu URL(s) — with enough detail for us to locate it.
4. Your details Your full name, mailing address, telephone number, and email address.
5. Good-faith statement A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

Incomplete notices will be rejected. Under the DMCA, a notice missing any of the six elements above is not actionable, and we cannot remove the content in response to it.

5. Filing a Counter-Notice

If your content was removed from KichuKichu in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice through our contact form.

To be valid, a counter-notice must include:

When we receive a valid counter-notice, we will forward it to the original complainant. Unless the complainant notifies us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the removed content.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, KichuKichu maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

We may also limit access to the Service and/or terminate accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

7. Misrepresentation Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing — or that material was removed by mistake or misidentification — may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner, or the service provider.

Do not file false notices. Please consult a qualified attorney before submitting a DMCA notice or counter-notice if you are unsure of your rights.
